Slow House – Conditions of Entry, Waiver & Risk Acknowledgement
(Legally Binding Agreement – Please Read Carefully)
This Conditions of Entry, Waiver & Risk Acknowledgement (the “Agreement”) is made between you (the “Participant” or “you”) and Hellthy Pty Ltd (ABN 17 168 221 841), the operator of Slow House (“Slow House”, “we”, “us”, or “our”).
By entering Slow House and/or participating in any of the services or experiences provided, you acknowledge and agree to the following legally binding terms:
1. Agreement to Terms
1.1 By entering Slow House, participating in any Recreational Activities, or using our premises, you agree to the terms and conditions in this legally binding waiver.
1.2 If you do not accept these terms, you must not enter the facility or participate in its offerings.
1.3 Access to and use of the Slow House facilities, amenities, and services is strictly subject to these Conditions of Entry.
2. Acknowledgement of Risk
You acknowledge and agree that:
2.1 You voluntarily assume all risks of Injury or Illness associated with entering or using the facilities at Slow House, including but not limited to:
- Slipping on wet or tiled surfaces
- Navigating stairs and uneven surfaces
- Exposure to extreme temperature variations (hot and cold)
- Equipment malfunction or misuse
- Actions, omissions, or negligence of other guests or staff
2.2 This list is illustrative and not exhaustive of all possible risks.
2.3 Some or all Recreational Activities may not be suitable during pregnancy. You are solely responsible for obtaining medical clearance prior to participation. Pregnant women are not permitted to use any Slow House services or facilities due to elevated risks including heat exposure and pressure therapy.
2.4 You represent and warrant that you have no pre-existing Injury or Illness or condition that may increase your risk of harm.
2.5 You enter the premises and participate in all activities voluntarily and at your own risk.
2.6 Slow House staff may (at your expense) take reasonable steps to protect your welfare in the event of Injury or Illness, including calling emergency services. However, we are under no legal obligation to do so.
2.7 To the fullest extent permitted by law, any guarantees that would otherwise be implied under the Competition and Consumer Act 2010 (Cth), including under section 139A(3), are excluded. Where liability cannot be excluded, it is limited to the resupply of services.
3. No Limitation on Reckless Conduct Liability
Nothing in this Agreement limits your rights under the ACL in relation to personal injury resulting from reckless conduct by Slow House, as defined under section 139A of the Competition and Consumer Act 2010 (Cth).
4. Waiver and Indemnity
You:
4.1 Waive, release and hold harmless Hellthy Pty Ltd (trading as Slow House), its directors, officers, employees, contractors, affiliates, and representatives from any and all liability, claims, or causes of action arising from your participation in any activities or use of the premises, including for Injury or Illness.
4.2 Indemnify Slow House against any loss, claim, liability, or expense (including legal fees) incurred as a result of your conduct or any breach of this Agreement.
5. Personal Belongings
Slow House accepts no responsibility for lost, stolen, or damaged personal belongings. Please avoid bringing valuables into the facility.
6. Age Restrictions
6.1 Entry is restricted to persons aged 16 years and over.
6.2 Guests aged 16–17 may only enter when accompanied by a responsible adult (18+) who must remain on the premises and supervise them at all times.
6.3 No persons under 16 are permitted entry under any circumstances.
6.4 The accompanying adult accepts full responsibility for the minor’s conduct, safety, and adherence to these terms.
7. Definitions
Injury means physical or mental harm, including aggravation, acceleration, or recurrence of such harm. This includes:
- Sprains and ligament damage
- Broken bones
- Muscle or soft tissue injuries
- Cuts, abrasions, burns
- Overheating (e.g. heatstroke)
- Cardiovascular stress or failure
- Drowning
- Mental illness
- Loss of or complications related to pregnancy
- Death
Illness means any illness, disease, or condition (whether physical or mental), including those aggravated or triggered by use of the facilities.
Recreational Activities refers to participation in or use of any and all services, amenities, or facilities at Slow House, including but not limited to:
- Infrared saunas and steam rooms
- Ice baths, cold plunge, hot spa, and magnesium pools
- Massage and facial treatments
- Relaxation zones, showers, and amenities
- Consumption of food and beverages
- Any other service or experience offered now or in future
8. Acknowledgement of Agreement
By entering Slow House and/or participating in any Recreational Activity, you:
8.1 Confirm that you have read and understood these Conditions of Entry;
8.2 Acknowledge that this document is a waiver and release of liability and that you voluntarily accept all associated risks;
8.3 Agree that the waiver applies regardless of who paid for your visit (you or someone on your behalf);
8.4 Confirm you are at least 18 years of age or the legal guardian of a 16–17-year-old who is entering under your supervision.
9. Governing Law and Severability
9.1 This Agreement is governed by the laws of New South Wales, Australia.
9.2 Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
9.3 If any part of this Agreement is found to be invalid or unenforceable, the remainder will continue in full force and effect.
9.4 These terms may be updated from time to time. The latest version will be made available on our website and at reception.
